The Uttar Pradesh real estate regulatory authority (UP-RERA) has instructed promoters to verify their legal ownership of the land before registering their projects.
If the land doesn’t belong to the promoter but to someone else, they must have the landowner’s permission through a registered joint development agreement.
Promoters also need to submit an affidavit confirming that the project land is free from any legal claims or issues.
Sanjay Bhoosreddy, chairman of UP-RERA, emphasized that promoters must obtain the necessary permits for the project and transfer ownership to buyers through registered documents.
These directives are crucial because without legal ownership or consent from the landowner, promoters can’t legally transfer ownership to buyers.
Such issues can complicate the registration process for projects with UP-RERA.
